Rochester, MN (KROC AM News) -  The owner of a Rochester restaurant is suing the city over a development fee it says is illegal and its lawsuit seeks to make it a class action - which would add more businesses to the case.

The lawsuit was filed this week in Olmsted County Court by Tap House Real Estates, owner of Tap House West End located along West Circle Dr.

The lawsuit centers on the city’s use of Transportation Improvement District fees.

The lawsuit says the fees are illegal and seeks a full refund for all who have paid over the years, which it says could be in the “tens of millions of dollars.” The fees are used to help pay public traffic infrastructure costs related to new development projects.

 

The lawsuit says Tap House “involuntarily paid under duress” $102,500 in TID fees in 2019.
