Rochester, MN (KROC-AM News)- A sentencing date has been set for the Rochester man convicted of carrying out a shooting near the Olmsted County Fairgrounds last year.

He entered a guilty plea in Olmsted County Court last week. The shooting happened following an altercation involving a group of people outside of a quinceanera party at Graham Arena 3 on the night of September 2. 

Rochester Police identified the suspected shooter as 19-year-old Kelvin Armando Figueroa-Millan.

Officers found three spent shell casings at the scene of the shooting, the criminal complaint in the case says. No injuries were reported. Police arrested Figueroa-Millan during a traffic stop on the morning of October 6.

He was charged with second-degree assault and a felony count of reckless discharge of a firearm on October 10. 

Figueroa-Millan entered a plea deal that calls for him to admit to the second-degree assault charge in exchange for the dismissal of reckless discharge of a firearm count.

Figueroa-Millan’s attorney plans to argue for a downward departure at the sentencing hearing. 

The court document indicates the presumption sentence for a second-degree assault conviction in three years in prison. Figueroa-Millan’s sentencing hearing has been scheduled for August 7.
