Rochester, MN (KROC AM News) - A Rochester man who was convicted of murder in a deadly heroin overdose has lost his appeal of the conviction.

A 3rd-degree murder charge was filed against 55-year-old Darnell McDaniels in the 2015 death of a man found unresponsive in his room at a Rochester halfway house. Police said the victim died less than two hours after taking heroin he bought from McDaniels.

At the time of the deadly overdose, Rochester police indicated they suspected McDaniels had been selling heroin to other people who suffered non-lethal overdoses. He has a history of selling drugs in the Rochester area.  In fact, McDaniels was sentenced to 4 years in prison in 2016 for an earlier conviction.

McDaniels was convicted last year in the deadly overdose case and sentenced to 13 years in prison. He appealed but the state Appeals Court denied his request in an order that was issued Tuesday.
