Charges: Video Shows Byron Dog Walker Threatening Neighbor With Gun
The Olmsted County Sheriff’s Office responded to an assault call at a residence in Byron shortly before 6 p.m. on Thursday. The victim, described as an adult male, reported his neighbor had threatened him with a gun.
He showed deputies the video he took, which depicts him walking 10-15 feet behind the defendant, identified as 77-year-old Roy Earl Diehl.
Deihl was walking with his dog and the victim told Deihl that the dog needed to be leashed. Deihl responded by telling the victim to stay back, the complaint says.
The video shows the two men continuing to walk and Deihl telling the victim to not come closer. As Deihl issued the second warning, he’s seen withdrawing a black handgun and pointing it at the victim, the charges say.
Footage shows Deihl’s finger on the trigger and telling the victim to stay away as he walks towards the victim, who appears to be retreating from the Byron man, the complaint states.
Multiple witnesses told deputies they saw Deihl point the gun at the victim, according to the court filing. The complaint does make a further mention of the firearm.
Deihl has been charged with a count of felony terroristic threats and a gross misdemeanor dangerous weapons charge.
He was released without bail following his arraignment on Friday and is due back in court later this month.
