Rochester, MN (KROC AM News) -  The city finally ran out of a patience with a Rochester man and the case of an illegal antenna is now in the courts.

The case centers on a nearly 60-foot tall antenna that was put on top of a house at 1818 9th Ave SE, across the street from Ben Franklin school.

The city became aware of the situation in January and discovered it had been installed without a permit and was in violation of zoning restrictions because it was 25 feet higher than allowed. The house is owned by 79-year-old Margaret Knutson, who has a different address.

The city began working with her son Daniel who lives at the home. Court records show he told officials he didn’t think he needed a permit. The city’s Building Safety Department and planning staff had frequent contact with Knutson but he refused to apply for a permit.

A final violation notice was sent to Knutson last month. When he failed to respond, the City Attorney’s office took over and has filed two separate misdemeanor cases against Margaret Knutson.

She has been ordered to appear in court next month.
