Recently Sentenced Rochester Man Charged With Burglary

Rochester, MN (KROC-AM News) - A Rochester man who was sentenced earlier this month in connection with an assault and drug bust three years ago is facing new charges.

Sentenced Earlier This Month, Rochester Man Faces New Charges

The criminal complaint filed in Olmsted County Court charges 38-year-old Shueb Abshir Noor with first-degree burglary and misdemeanor trespassing. His conditional bail is set at $15,000.

The court document says Rochester police were dispatched to an apartment building in southeast Rochester just before noon last Friday and encountered Noor outside the residence with a cut on his cheekbone and blood running down his cheek. Police were responding to a report that someone had been struck with a stick.

Accused of Breaking Into Disabled Man's Apartment

When the responding officers spoke to the man living in the apartment, the criminal complaint indicates he was in his bedroom getting ready for the day when he heard someone tapping on the window and found Noor standing outside. He stated that Noor asked to be let in, but the victim refused.

According to the charges, the victim later exited his bedroom and found Noor standing in his living room. The court document indicates the victim told police he ordered Noor to leave, but Noor became "hostile, belligerent, and made hostile moves toward him." The victim said he responded by striking Noor with his walking stick in self-defense before fleeing into his bedroom and locking the door until police arrived.

Disabled Victim Says He Struck Suspect in Defense

A witness living in an adjacent apartment told police he heard a commotion and went to check on his neighbor because he is disabled. The witness described finding the screen door and the main entrance to the apartment already open and Noor inside. Another witness told police he called law enforcement after finding Noor outside the victim's apartment.

Court documents show that Noor had previously been trespassed from the victim's residence and had been ordered to stay away from the property.

Recent Conviction in 2023 Assault and Drug Case

Noor was recently sentenced for a second-degree drug possession conviction stemming from an incident in April 2023. As part of his plea agreement, a second-degree assault charge and a second-degree riot charge involving a dangerous weapon were dismissed.

The criminal complaint in that case alleged that Noor participated in an assault on a man who was walking his daughter home from school. Noor was also accused of pointing a gun at the victim after he and his daughter fled into a nearby residence at the Meadow Park apartment complex.

After police responded to the reported assault, the court document says officers found Noor and two other men in another apartment, where a handgun was located in a closet along with nearly 500 fentanyl pills.

Jail and Probation

Noor was sentenced to one year in jail with credit for the 202 days he had already spent in custody. He was also placed on probation for five years and given a stayed 48-month prison sentence that could be be imposed if he fails to successfully complete probation.

Court records do not indicate why Noor was not in custody when the latest incident occurred Friday.
