Felony Charge Swapped For Gross Misdemeanor in Rochester Assault
Rochester, MN (KROC-AM News) - A Rochester man accused of an assault that left another man with significant injuries today entered a plea agreement and admitted to a gross misdemeanor charge.
Court documents say 29-year-old Irwin Arnold Herrera was arrested the day after the assault was reported on the night of March 10. According to the criminal complaint, the victim told Rochester Police that Herrera had approached him and punched him on the head, causing him to fall to the ground.
The victim indicated that he lost consciousness for about a minute and when he regained consciousness, he stated that he felt Herrera punching him another 20 to 25 times. A witness told police she saw Herrera punching the victim in the face before he got onto a bicycle and rode away.

The criminal complaint stated that the victim was taken to a local hospital and was treated for broken orbital bones, broken jaw bones, and a likely concussion. It also says that, at the time of his arrest the following afternoon, the arresting officer noted that Herrera's hands were swollen with abrasions on his knuckles.
Hererra was charged with a felony count of third-degree assault, but under the terms of the plea deal finalized today, he entered a guilty plea to a gross misdemeanor count of harassment and was sentenced to two years on probation.
