Rochester, MN (KROC-AM News)- An Eyota man has been accused of brandishing a pistol and using it to knock a person unconscious in Rochester earlier this year.

38-year-old Joseph Johnson was charged Tuesday with second and third degree assault and possessing a firearm as a felon. The criminal complaint says Johnson was at a shop in southeast Rochester with two other people when he got into an argument with one of the people he was with that turned physical when Johnson brandished a pistol on June 13.

The victim in the case said Johnson then tried to shoot him but the gun jammed. Johnson then hit the victim in the face with the weapon, rendering the man unconscious, according to the complaint. The man with Johnson and the victim told police he did not see the alleged assault but said he saw the victim lying on the ground and was not sure if the victim was conscious, the complaint states.

Court records indicate Johnson was convicted of a felony drug possession crime in Scott County in 2019. Documents from that case indicate Johnson was caught with meth and marijuana in his vehicle after being spotted smoking in the parking lot at Mystic Lake Casino. He’s been summoned to appear in Olmsted County Court on October 27.
