Rochester, MN (KROC AM News) – A Mantorville man who accidentally struck and killed a young boy with his car last year was sentenced to probation and given a 30 day jail term Friday.

Sentenced was 70-year-old Myles Keller.

He will be on probation for one year and has been ordered to serve half the jail sentence this year and the other 15 days next year. He will have work release privileges. He has also been ordered to perform 40 hours community work service.

Keller pleaded guilty earlier to a misdemeanor DUI charge. He had been charged with reckless driving and two DUI counts after tests indicated he had a blood/alcohol concentration of between .08 and .10 when his car struck 5-year-old Lukas Wharton while the boy was riding in a wagon in front of his family’s Byron home.

Keller entered an Alford plea, meaning he doesn’t admit guilt but agrees there is enough evidence to lead to a conviction if the case went to trial.

His sentencing order also prohibits him from consuming alcohol or entering places where it is sold during his probationary period.
